SmartSafe GPS Tracking – TERMS & CONDITIONS
1. Description of goods/services/Company
SmartSafe is a business in the manufacturing, imports and supply of products to the Commercial and Security Markets
2. Delivery policy
Subject to availability and receipt of payment, requests will be processed within 72 hours and delivery confirmed by way of email/ and/ or telephone. Courier charges will be quoted separately.

The provision of goods and services by SmartSafe is subject to availability. In cases of unavailability, SmartSafe will refund the client in full within 25 days.
Faulty product must be returned in original packaging at the cost of consumer. Should investigation prove a factory fault, consumer will be refunded or product replaced including shipment cost. The returned items must be accompanied by original packaging and proof of payment. Cancellation of orders by the client will attract a 5% administration fee. Any returns of products in terms of the Consumer Protection Act (the “CPA”) will be dealt with in accordance with the provisions of the CPA. The Consumer hereby confirms that he/she is aware of the provisions of the CPA and that he/she will comply with the provisions of the CPA and more specifically section 56 of the CPA which provides that a consumer has the right to receive goods which are of good quality and are reasonably suited for the purpose for which they are intended for. If the goods are found to be in contravention of the above, the consumer has the right to, within ONE months of purchase, cancel the sale and request a refund, on condition that the product is returned in its original packaging with proof of payment. The company will not accept any “goodwill refunds”.
SmartSafe shall take all reasonable steps to protect the personal information of the consumer. SmartSafe will ensure compliance the the POPi Act. For the purpose of this clause, ‘personal information’ shall be defined as detailed in the promotion of Access to Information Act 2 of 2000 (PAIA). 6. Payment options
Payment may be made via Visa, MasterCard, Diners or American express cards or by bank transfer into the SmartSafe bank account, the details of which will be provided on request.
7. Card acquiring and security
Card transactions will be acquired for SmartSafe via Payfast (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. Payfast uses the strictest form of
encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.payfast.co.za to view their security certificate and security policy.
8. Customer Billing info
Customers billing info will be stored by SmartSafe separately from card details which are entered by the client on the Payfast secure site.
9. Merchant outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
SmartSafe takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support and dispute resolution. Delivery of goods will be done via a courier company nominated by SmartSafe and will be for the customer’s account. Separate quote will be provided on the checkout page of the website during the purchase process.
11. Country of domicile
This website is governed by the laws of South Africa and SmartSafe chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
SmartSafe may, in its sole discretion, change this agreement or any part thereof at any time without notice.
